We may ask you to provide a police certificate (also called a penal clearance certificate) from every country you lived in. If we ask you for one, it will usually be if you are over 17 and lived in any of the listed countries, including Australia, for at least 12 months in the past 10 years.

Please note that the Australian Department of Home Affairs are now insisting on the version con excepción Artículo 51 Codigo Penal. Many clients have requested translation of the broader version with no exceptions in the past, but it no longer appears to be accepted for immigration purposes (despite actually being a more extensive check).

Brazil: Certidão de antecedentes criminais

- Certidão de Antecedentes Criminais (Federal Justice Department AND State Justice Department)
- Federal Justice Department: The immigration department request the certificate issued by the Justiça Federal for Brazilian citizens, and the one issued by the Policia Federal for tourists only. Despite this, the certificate seen most frequently for translation by Brazilians and temporary residents alike is actually the one issued by the Policia Federal.

The ‘Certidao Negativa’, ‘Certidao de Distribuiçao’, ‘Certidao Judicial’ or “Certidao regional para fins gerais” documents are issued by Federal Justice (Justiça Federal) and cover the civil and criminal courts. A Federal Justice police clearance should be obtained for each state where you have resided for a cumulative period of 12 months or longer in the last 10 years since reaching the age of 16 years. As the Federal Courts are divided by regions with jurisdiction over different states, you will have to refer to the website of the regional tribunal relevant to their case.

Depending on the state, State Justice Department certificates may be provided by ‘Justiça Estadual’, ‘Secretaria de Segurança Publica’, ‘Tribunal de Justiça’, ‘Departamento de Policia Civil’. Certificates may be referred to as ‘Atestado de Antecedentes Criminais’ or ‘Declaraçao’ or ‘Certidao’.
Certificates should be provided for each state in Brazil in which you have resided for a cumulative period of 12 months or longer in the last 10 years since reaching the age of 16 years.
You can obtain a State Justice clearance online in most states by providing your Brazilian National Identity card number known locally as ‘Registro Geral’ (RG). Foreigner identification cards are referred to as ‘Carteira de Registro Nacional Migratorio’, ‘Registro Nacional de Estrangeiros’ (RNE) or ‘Registro Nacional Migratorio’ (RNM).
If you are unable to obtain the State Justice clearance online, you might need to apply in person or give a Power of Attorney (Procuraçao) to a family member or friend in Brazil to obtain the certificate on your behalf. As processes for obtaining State Justice certificates vary by state, you should make contact with the relevant authorities on how to apply.

Colombia: Constancia de antecedentes judiciales with apostille

Citizens and non-citizens not resident
Apply for both certificates, to the ‘Criminal Records Office’ in Rome (Procura della Repubblica presso il Tribunale di Roma) at the address below. Applications may be lodged by post or in person. An authorised person may be nominated to apply for the documents on the applicant’s behalf. An authorised person may be a relative, friend, lawyer or service agency in Italy.
Documents required
● a completed application form: Form no. 3 (Judicial records register / Casellario Giudiziale), available on the Rome Appeal Court’s website below. The form is a combined application form for both required certificates. The required certificates need to be marked at the top of the form
● identity documents
● a statement authorising a third party to apply for and/or receive the certificate on your behalf (if applicable)
● a return envelope bearing the address where the certificate(s) is/are to be mailed to, (standard format 90 x 140mm or 120 x 235mm weight up to 20g, thickness 5mm)
● proof of payment of the total amount due. This includes a fee for the actual certificates, stamp duties, postage costs and a charge to cover bank fees if a transfer is made from a country not belonging to the Single Euro Payments Area (SEPA) (generally non-European countries).
Payment can be made by international bank transfer. For bank details, applicants need to send an email to casellario.procura.roma@giustizia.it.
Postal orders can be accepted for applications from Spain, France, Portugal, Albania, Andorra and Greece.

Incomplete requests or those not following the instructions regarding payment and other required details will be rejected.

*Please note: Since early 2020, the certificate issued by the Procura della Repubblica for immigration purposes is now simply titled Certificato del Casellario Giudiziale. This seems to have replaced the previous range of options, including:
- Certificato Generale del Casellario Giudiziale,
- Certificato Penale del Casellario Giudiziale, and
- Certificato del Casellario Europeo.
While the Australian Department of Home Affairs website still requests the Certificato Generale, the Certificato del Casellario Giudiziale is the standard one being issued.
